These Terms of Use (“Terms”) govern the use of the online platform PMG Academy (“Platform”), provided by PMG Academy LLC, a company registered in Delaware, United States, with its principal office located at:

PMG Academy’s mission is to improve lives through education. These Terms apply to all your activities on the PMG Academy website and related services (“Services”).

“Content” means any information, text, graphics, videos, downloadable materials or any other content made available on the Services.

All of our services — including courses, support, and customer service — are 100% online and remote, allowing you to access them from anywhere in the world without the need for physical presence.

This remote operation ensures flexibility and convenience for you and our team, aligning with global best practices for remote work and providing efficient and satisfactory service.

Upon purchasing a course, service, or product from PMG Academy, the student agrees that the contractual relationship established between the parties is of a continuous and indefinite nature, with its validity being subject to the periodic renewal of payments and/or the acquisition of new products or services.

The provision of educational services may be renewed at the student’s discretion, without any prior time limitation, thereby characterizing a long-term commercial relationship with the possibility of continuity exceeding 12 months.

PMG Academy undertakes to maintain the availability of the contracted services and to offer commercial renewal conditions in order to ensure the continuity of the educational experience, in compliance with applicable legal regulations.

By enrolling in a course, purchasing an exam, or acquiring materials from PMG Academy, you agree to these Terms. Detailed information about the processing of your personal data can be found in our Privacy Policy.

1. Use of the Service

1.1. 1.1. If you do not agree with the updates to these Terms of Use, your access to the Platform may be suspended until you accept the new conditions.

1.2. 1.2. Updates to the Terms will be published on the website at least 15 days prior to taking effect, except in exceptional cases required by law.

1.3. 1.3. Continued use of the Platform after the notification period will be considered your acceptance of the changes. We recommend that you periodically review the Terms.

1.4. 1.4. PMG Academy may, at any time and without prior notice, modify, suspend, or discontinue the Service or its features, in whole or in part, or impose usage limits as necessary for operational purposes.

2. User Account

2.1. 2.1. To create your account and use our Services, you must provide truthful, complete, and up-to-date information, including your real name, email, address, phone number, age, and ID Identification.

2.2. 2.2. You are responsible for keeping your password secure and confidential. We recommend using strong passwords containing uppercase and lowercase letters, numbers, and symbols. PMG Academy is not responsible for losses resulting from improper use of your password.

2.3. 2.3. Our system may identify weak passwords and request a change. If you do not make the change, we may enforce the creation of a strong password, which you may later change.

2.4. 2.4. Your first name and nickname registered cannot be changed after registration to ensure the authenticity of issued certificates. Changes may be reviewed upon formal request with valid documentation.

2.5. 2.5. You agree to keep your personal information accurate and updated. Otherwise:

(i) you may lose access to the Platform; or
(ii) PMG Academy may terminate these Terms and your access.

2.6. 2.6. You are responsible for all activities performed on your account and agree to keep your login credentials and content confidential.

2.7. 2.7. Your account is personal and non-transferable, and its sale or assignment to third parties is prohibited. PMG Academy is not responsible for misuse by others.

2.8. 2.8. All elements of the Platform (images, texts, logos, functionalities, content, and tools, except content created by you) are the exclusive property of PMG Academy. Unauthorized use of these elements outside the Platform, including reverse engineering, attacks, sale, or unauthorized licensing, is prohibited.

2.9. 2.9. PMG Academy is not responsible for the accuracy of information provided during registration but may request documents to verify identity.

2.10. 2.10. Your history and course progress data will be backed up for up to one (1) year. After this period, recovery may not be possible.

3. Login Sharing

3.1. 3.1. Sharing your login and password with others, whether they are students, visitors, or users of simulators, is strictly prohibited.

3.2. 3.2. Our system can detect simultaneous logins using the same username and password. If detected, access will be immediately blocked on all involved devices and IP addresses.

3.3. 3.3. If two or more simultaneous accesses are identified, PMG Academy may suspend the user’s access and charge a proportional fee for the unauthorized additional use of paid products (such as courses, e-books, simulators, or exams). The fee will be charged per detected IP or device, upon presentation of evidence. Access will remain blocked until payment is regularized. For more details, see item 13 (Indemnification).

3.4. 3.4. All materials provided in the courses are protected under Law No. 9,610/98 (Brazilian Copyright Law), which establishes:

(a) Article 22 – The author has moral and property rights over the created work.
(b) Article 28 – The author has the exclusive right to use, enjoy, and dispose of the literary, artistic, or scientific work.
(c) Article 29 – Use of the work depends on prior and express authorization from the author, except for exceptions provided by law.

4. Rights and Obligations of Students

4.1. 4.1. PMG Academy grants the Student a personal, limited, worldwide, non-exclusive, non-transferable, revocable license without sublicensing rights to use the Platform.

4.2. 4.2. The Student may download parts of the Content, when available, solely for personal and non-commercial use. Use of the Platform does not transfer any intellectual property rights over the Platform or its contents.

4.3. 4.3. The Student must respect all copyright notices and may not alter any legal notices or proprietary information contained on the Platform.

4.4. 4.4. The Student is prohibited from, when using the Platform or PMG Academy Services:

(a) accessing or modifying non-public areas of the platform, systems, or servers;
(b) providing false information or impersonating another person, including on affiliated groups or social networks;
(c) committing fraud in any activities, services, or content;
(d) reproducing, copying, selling, or commercially exploiting content or services without authorization;
(e) using PMG Academy’s trademarks, names, or content for unauthorized purposes;
(f) using automated methods to access the Platform, such as bots or crawlers;
(g) interfering with the services, servers, or networks of the Platform;
(h) attempting to bypass security measures or testing vulnerabilities without authorization;
(i) copying, modifying, reverse engineering, or decrypting the Platform’s source code;
(j) accessing the Platform by unauthorized means, except via official search functionalities and API;
(k) usar scraping, spider ou outros meios automatizados para acessar os Serviços;
(l) sending communications with false or disguised origin information, such as spoofed emails;
(m) interfering with, disrupting, or overloading access for other users or the Platform infrastructure;
(n) posting content that infringes on third-party copyrights or trademarks;
(o) sharing login credentials with third parties.

(a) participate in and respond to questionnaires, tests, and evaluations to ensure the Platform’s proper functioning;
(b) complete the course to receive a completion certificate;
(c) use the Platform in appropriate environments, respecting health recommendations regarding screen time and distance;
(d) periodically review the Terms of Use and Privacy Policy.

4.6. 4.6. Individual access allows the Student to watch courses, comment, complete exercises, and participate in discussion forums available on the Platform.

4.7. 4.7. Completion certificates will indicate only the course completion date, when applicable, and will be available for printing at any time during an active subscription or up to three (3) years after enrollment.

5. Content Published by the Student

5.1. 5.1. By publishing content, comments, questions, evaluations, ideas, or suggestions on our Platform, you authorize PMG Academy to use, share, distribute, and promote such content on any platform or media, and to make modifications or edits as necessary.

5.2. 5.2. You grant PMG Academy a worldwide, non-exclusive, royalty-free license with the right to sublicense to use, copy, reproduce, adapt, publish, transmit, and distribute your content by any means, whether currently known or developed in the future.

5.3. 5.3. This license includes sharing your content with partners, companies, and organizations affiliated with PMG Academy for purposes of promotion, marketing, and broadcasting, waiving, to the extent permitted by law, any privacy, publicity, or similar rights.

5.4. 5.4. You represent and warrant that you possess all rights and authorizations necessary to grant this license over the content you submit.

5.5. 5.5. You agree that you will not receive any compensation for the use of your content as described in these Terms.

(a) infringes copyright, trademarks, or intellectual property rights of others;
(b) discloses trade secrets without authorization;
(c) violates privacy or publicity rights of others;
(d) is defamatory, abusive, threatening, offensive, hateful, or illegal;
(e) publishes actual exam questions, regardless of excerpt or format;
(f) discloses personal information of third parties without consent;
(g) contains viruses, malware, or any malicious code.

5.7. 5.7. PMG Academy may, at its discretion, remove any content deemed inappropriate, suspend or terminate your account, or take other legal actions.

5.8. 5.8. Your content may be viewed and republished by other students or third-party services. Therefore, only submit content you are willing to share.

5.9. 5.9. You are solely responsible for the content you publish, including any consequences resulting from its use by others. PMG Academy does not monitor all content available on the Platform.

5.10. 5.10. We reserve the right to remove or refuse distribution of any content and to delete user accounts that violate these Terms.

5.11. 5.11. By accepting these Terms, you grant PMG Academy a worldwide, non-exclusive, royalty-free license to republish your content on PMG Academy and the internet, provided the content was submitted after September 1, 2013, unless you explicitly mark the content as “Not for Reproduction.”

6. Rights and Obligations of PMG Academy

6.1. 6.1. We reserve the right to access, read, preserve, and disclose any information whenever we consider it necessary to:

(a) comply with laws, regulations, legal processes, or government requests;
(b) enforce these Terms, including investigating potential violations;
(c) detect, prevent, or resolve fraud, security issues, or technical problems;
(d) respond to student support requests;
(e) protect the rights, property, and safety of PMG Academy, its students, and third parties.

6.2. 6.2. All rights, titles, and interests in the Platform, Services, website, databases, and content provided by employees or partners (excluding content generated by students) are and will remain the exclusive property of PMG Academy and its licensors.

6.3. 6.3. Feedback, comments, or suggestions voluntarily provided by students about PMG Academy or its Services may be freely used by PMG Academy without any obligation of compensation or acknowledgment.

6.4. 6.4. The curriculum content of courses may be changed, restricted, removed, or expanded at any time without altering the contracted object or the price paid by the student.

6.5. 6.5. The estimated duration of courses is an average based on video length, number of exercises, self-assessment, and forum participation, and may vary according to the student’s pace.

7. Property Rights

7.1. 7.1. Our platforms, services, and content are protected by Brazilian copyright, trademark laws, and other applicable legislation.

7.2. 7.2. Users do not acquire any rights to use the name “PMG Academy,” its trademarks, logos, domain names, or any other distinctive brand elements.

7.3. 7.3. All rights, titles, and interests related to the Service (except content provided by users) are the exclusive property of PMG Academy and its licensors.

7.4. 7.4. The Service is protected by copyright laws in Brazil and other countries. Except as authorized in these Terms, no rights to use PMG Academy’s trademarks, names, or special content are granted to the user.

7.5. 7.5. Any comments, suggestions, or feedback you submit about the Service are voluntary and may be freely used by PMG Academy without any obligation to compensate.

7.6. 7.6. The Service may contain advertisements related to content or information about the service. PMG Academy, its partners, and third-party providers may display such advertisements at their discretion and may change their format and scope at any time.

8. Privacy

PMG Academy values and protects your privacy. To understand how we collect, use, store, and protect your personal data, please consult our Privacy Policy.

By using our Services, including from outside Brazil, you agree that your personal data may be transferred to and processed in Brazil, in compliance with Brazilian laws, the General Data Protection Law (LGPD), and, where applicable, the European Union General Data Protection Regulation (GDPR).

9. Notification

9.1. 9.1. PMG Academy may contact you via email, phone calls, text messages, instant messaging apps, and/or notifications on the Platform.

9.2. 9.2. You agree to receive communications from PMG Academy regarding Platform information, promotions, marketing, job openings, new content, or advertisements we consider relevant to you.

9.3. 9.3. You may opt out of receiving promotional and marketing messages at any time. However, we will continue to send urgent and necessary communications based on our legitimate interest, such as information about your account, payments, course progress, and Platform access.

9.4. 9.4. PMG Academy may share your content and information with affiliates, partners, employees, third-party service providers, and collaborators who contribute to the operation of the Platform, always in compliance with our Privacy Policy and applicable data protection laws.

10. Emails Marked as SPAM

10.1. 10.1. After your registration, we will send important transactional messages such as welcome emails, enrollment confirmations, password resets, course completions, as well as marketing messages. All messages include an option at the footer for you to manage your email preferences.

10.2. 10.2. We use Amazon SES SMTP service, which enforces strict rules against SPAM. To protect system integrity and ensure message delivery to all users, we automatically block access for any user who marks our emails as SPAM.

10.3. 10.3. Once blocked, account reactivation is not possible, as the blocking system is automatic to prevent total service suspension.

10.4. Even if the appointment was a mistake, it will not be possible to reverse the block. We therefore ask you NOT TO INSIST on reactivation in these cases.

10.5. 10.5. If you wish to return to the Platform after a SPAM-related block, you will need to create a new account with a different email address.

11. Price

11.1. 11.1. By purchasing a Plan, you agree to the prices and payment terms presented at the time of purchase on the PMG Academy website.

11.2. 11.2. Prices may be adjusted after twelve (12) months from the date of purchase, at PMG Academy’s discretion, market conditions, or by mutual agreement before that period.

11.3. 11.3. Payments may be made by credit card, bank slip (boleto bancário), or other payment methods made available on the website.

11.4. 11.4. In case of late payment, access to the service may be suspended until the payment is regularized.

11.5. 11.5. For detailed information on warranties, cancellations, and refunds, please consult our Cancellation and Refund Policy.

12. Updates and Revisions of the Terms

12.1. 12.1. PMG Academy may update these Terms of Use periodically to reflect legal, operational, or market changes.

12.2. 12.2. When relevant updates occur, you will be notified at least fifteen (15) days in advance via the registered email and/or notification on the Platform.

12.3. 12.3. Continued use of the Platform after this period will be considered your acceptance of the new conditions. If you do not agree with the changes, you may discontinue using the Platform.

13. Disclaimer and Limitation of Liability

13.1. 13.1. The Platform and all its content are provided “as is.” PMG Academy does not guarantee continuous, error-free, secure, or virus- and malware-free access.

13.2. 13.2. PMG Academy does not warrant the reliability, quality, timeliness, or fitness of the Platform for any particular purpose.

13.3. 13.3. PMG Academy shall not be liable for any direct or indirect damages, including financial losses, lost profits, moral damages, or any other harm resulting from use, inability to use, or reliance on the Platform, even if warned of such risks.

13.4. 13.4. You acknowledge that these liability limitations are essential for PMG Academy to provide the service and remain valid regardless of the functioning or purpose of the offered features.

13.5. 13.5. We do not guarantee availability of specific content or a minimum amount of material in any Subscription Plan.

13.6. 13.6. We reserve the right to modify, suspend, or terminate features or plans at any time without prior notice.

13.7. 13.7. The Platform may become temporarily unavailable due to maintenance, technical failures, or security issues. In such cases, you agree that no compensation may be claimed.

13.8. 13.8. Under no circumstances shall PMG Academy, its affiliates, suppliers, or partners be liable for damages caused by service interruptions or unavailability.

13.9. 13.9. PMG Academy is not responsible for delays or failures resulting from events beyond its control, such as wars, natural disasters, power outages, internet or telecommunications failures, or governmental restrictions.

14. Indemnification

14.1. 14.1. PMG Academy may, at any time and at its sole discretion, suspend or block your access to the Platform without any obligation to indemnify for damages, if there is a reasonable risk that you are violating any part of these Terms.

14.2. 14.2. Examples of violations that may lead to such measures include, but are not limited to:

(i) making unauthorized changes to the Platform;
(ii) engaging in acts that promote or facilitate illegal activities, such as racism, discrimination, violation of fundamental rights, crimes against honor, life, or property;
(iii) using more than one Student Account per person.

15. General Provisions

15.1. 15.1. If your behavior causes legal issues, PMG Academy may take appropriate legal action against you. You agree to indemnify, defend (when requested), and hold harmless PMG Academy, its affiliates, officers, directors, suppliers, partners, and representatives from any claims, losses, damages, or expenses (including attorney fees) arising from:

(a) content you publish or submit;
(b) your use of the Services;
(c) your violation of these Terms;
(d) your violation of third-party rights.

This indemnification obligation will remain valid even after these Terms or your use of the Services ends.

15.2. 15.2. Use of the Platform is at your own risk. PMG Academy does not guarantee the integrity, accuracy, availability, security, or reliability of the Service or its content and is not responsible for damage to your system, data loss, or other harm resulting from use of the Platform.

15.3. 15.3. You agree that PMG Academy is not responsible for deletion, failure to store, or transmission of content or communications on the Platform. PMG Academy also does not guarantee that the Service will meet your needs or be always available, secure, or error-free.

15.4. 15.4. PMG Academy may, at any time and at its sole discretion, deactivate, suspend, or delete your Account if it deems that you:

(a) infringe intellectual property rights;
(b) make unauthorized information available or transmit such information;
(c) violate these Terms or the Privacy Policy.

15.5. 15.5. No advice or information, oral or written, obtained from PMG Academy or through the Service creates any warranty not expressly stated in these Terms.

16. Jurisdiction and Governing Law

16.1. 16.1. These Terms are governed by the laws of the Federative Republic of Brazil.

16.2. 16.2. For any disputes related to these Terms or the Platform, the courts of São Paulo, State of São Paulo, are exclusively chosen as the venue, to the exclusion of any other courts, however privileged they may be.
